Rape: El-Rufai signs Castration bill

Governor of Kaduna State, Nasir El-Rufai has signed into law the castration bill for convicted rapists. The new State Penal Code (Amendment) Law 2020, stipulates surgical castration and removal of Fallopian tubes for any male or female found guilty of raping a child in the state.

The state House of Assembly had recently amended Section 258 of the Penal Code Law No. 5 of Kaduna State 2017, with the following provisions

“Whoever commits rape of a child below the age of fourteen (14) years shall on conviction, be punished with Surgical Castration and death.

“Whoever has sexual intercourse with a male child below the age of fourteen years shall be punished with surgical castration and death.

“Where a female adult is convicted for the offence of rape of a child, the Court shall punish the accused with Bilateral Salpingectomy and death.

“Where the victim is above fourteen years, the Court shall on conviction sentence the accused with a punishment of surgical castration and life imprisonment.

“Where the convict is a child, the Court shall order as appropriate under the Children and Young Person Law Cap 26 Laws of Kaduna State 1991.

“Where the victim is a child, the Court shall in addition to the conviction, order that the convict be listed in the Sex Offenders Register to be published by the Attorney General.

“Where the Court is trying the offence of rape involving a child below the age of fourteen years, corroboration of a medical report shall be necessary.”

The governor received the amended penal code and signed it into law on Wednesday, September 16, the governor called for stiffer penalties for convicts, saying that they may assault more persons if they are sent to prison and released after completing their jail terms.

“In addition to life imprisonment or 21 years’ imprisonment, anyone convicted of rape will have his organ surgically removed so that even after he finishes his term, he will not be able to rape anyone again.

“So long as the tool exists, there is the likelihood that he may go back to do it again. Most of the perpetrators are young people, so even after 21 years, they can come back and continue. ”he said

  1. That is a welcome development if both offenders could be punished if found guilty of the offence. Castration for a man who is found culpable and those woman also who is also found guilty for the said offence. I hope this will curb or reduce this issue of raping drastically.

  2. In a first instance, I don’t know why would people rape not only rape but also molesting some children which they didn’t dress anyhow. All other government should emulate this and let severe punishment be meted to those offenders. Government should also do the same for those who is packing all our common wealth, so that corruption will reduce drastically.

  3. This your idea is good o, then what about those that are killing people in Southern Kaduna no penalty for them? So base on the rape case Its not by saying it o, but by putting it into action, maybe that will reduce the level of rape in this country and another thing is that both child marriage is rape case too.

  4. This is highly accepted. I was even suggesting ‘death sentence’ as an outright punishment for rapists so that they will leave this mother earth
    Rape to me is a crime against humanity and the perpetrators should be meant to suffer seriously
    If you want to have a canal knowledge of the opposite sex, it should be under mutual agreement and never should it be by force in any way

  5. Is a very good law, el-rufai really try, but make sure you do the same thing to does politicians that who ever steal our money should go to life impreasment.
