Atiku storms Supreme Court, seeks nullification of Tribunal judgment 

Alhaji Abubakar Atiku, the presidential candidate of the Peoples Democratic Party (PDP), has taken his case to the Supreme Court, seeking to overturn the Presidential Election Petition Court’s decision that upheld Bola Ahmed Tinubu as the winner of the 2023 presidential election on September 6.

Atiku’s Notice of Appeal, which outlines 35 grounds for his appeal, argues that the lower court made significant errors and a miscarriage of justice in its judgment. He contends that the tribunal did not accurately represent the grounds of his petition and urges the Supreme Court to set aside the findings and conclusions of the Tribunal, asserting they did not reflect the true essence of his case.

Additionally, Atiku maintains that the Tribunal made a legal mistake by not annulling the presidential election of February 25, 2023, due to non-compliance with the Electoral Act of 2022. According to Atiku, INEC conducted the election based on serious misrepresentation, contrary to the principles outlined in the Electoral Act of 2022 and the “doctrine of legitimate expectation.” The appeal was recently filed by Atiku’s lead counsel, Chief Chris Uche, SAN.
